Trade Group Seeks Guidance on Conservation Easement Grant Deeds

A trade group that supports syndicated conservation easement deals asked the IRS to issue sample deed grant language to avoid unnecessary disputes.

The Partnership for Conservation, a section 501(c)(4) trade group, said in its June 17 letter to the agency that “the IRS during audit will often challenge deductions for conservation easement donations by asserting that the language in the conservation easement grant deed is deficient in some minor technical respect,” making sample language appropriate.

The letter comes as the federal government’s scrutiny of conservation easements has increased dramatically in the past three years.
